Minnesota Annulment Law
In an annulment, one party requests a declaration from the court stating that the marriage was never valid. It is difficult to qualify for an annulment. Under Minnesota law, Minnesota Statute § 518.02, a marriage can be annulled under the following circumstances:
-
One party lacked mental capacity to consent to the marriage at the time of the wedding, unbeknown to the other spouse;
-
One or both spouses were under the influence of alcohol, drugs or other incapacitating substances;
-
One spouse lacks the physical capacity to engage in sex at the time of the wedding, unbeknown to the other spouse;
-
Where consent of either spouse was obtained by force or fraud and there was no subsequent cohabitation
