Mediation, Arbitration & Litigation

Mediation
Mediation is a non-binding and confidential process where a neutral third party helps resolve a disagreement. A lawyer can act as a mediator between two individuals or assist their client during mediation. Typically, mediation is a great alternative to litigation when dealing with divorces, family issues, or probate.
Arbitration
Arbitration is either a binding or non-binding process where a neutral third party makes a final judgment on a matter. The arbitration process is triggered if individuals who have previously agree by contract to resolve all disputes through arbitration enter into conflict or if both parties agree to arbitration. In binding arbitration, once the process starts all parties involved are bound to the arbitrator’s final decision.
Civil Litigation
Civil litigation is a judicial process by which disputes between two or more individuals is settled in court, usually for monetary damages. Individuals can file a claim from two to six years depending on the issue. For example, according to Minnesota law, personal injury cases must be filed within two years, while contract cases must be filed within six years. Once a plaintiff has filed a compliant the defendant will be served and a response is required within twenty-one days.
