Minnesota Prenuptial Agreements

A Prenuptial Agreement is a contract between two people about to marry, that spells out how assets will be distributed in the event of divorce or death.  Each individual must have their own attorney when entering into a prenuptial agreement.  Prenuptial agreements act as a safeguard for both you and your spouse-to-be.  It protects your assets and may prevents expensive litigation if a divorce should occur.  Business owners especially will want to consider a pre-nuptial agreement to protect business assets. 

In order for a prenuptial agreement to be enforceable in Minnesota under Minn. State 519.11 subd.1., it needs to be in writing, executed in the presence of two witnesses, acknowledged by the parties before a person to administer an oath, involve a full and fair disclosure of the earnings and property of each party and the parties must have had an opportunity to consult with legal counsel of their choice.
