Spousal Maintenance / Alimony
Spousal support, also referred to as alimony or spousal maintenance, is payments that are made to one spouse to keep their standard of living at the same level as when the spouses were married. Spousal maintenance can be permanent or temporary, depending on the circumstances of the spouses. Minnesota courts prefer not to decide how to award alimony. Minnesota courts prefer that the spouses work out spousal maintenance and other divorce arrangements themselves, but they will get involved if the spouses are not able to work it out for themselves. Spousal maintenance calculations are made pursuant to Minnesota Statute 518.552.
The Purpose of Spousal Support or Alimony
The purpose of alimony is to avoid any unfair economic consequences of a divorce even after property is divided and child support, if any, is awarded. Judges in Minnesota have been granted broad discretion in deciding what is fair in each case. Additionally, alimony can be modified or even eliminated as the divorced spouses’ needs change.
